COVID-19 ASSUMPTION OF THE RISKS AND WAIVER OF LIABILITY As a willing participant in classes at Muse Arts LLC, my family, caregivers, and I agree to the following:
ASSUMPTION OF THE RISKS: I understand that naturally occurring disease processes (including, but not limited to, the novel coronavirus or COVID-19), may exist in the community, including at Muse Arts, and present an inherent risk that cannot be eliminated. I acknowledge that, although Muse Arts is taking reasonable measures to avoid contact, transmittal, and exposure of disease processes like COVID-19 between people in our classes (including teachers and third parties), it is ultimately my own responsibility to ensure that I take appropriate actions to safeguard myself and my child/children, including all adults and children two-years-old and older wearing masks when arriving to, departing from, or leaving the family blanket at any time during class. All family members must stay within their personal blanket/area and ensure that personal items/instruments/props are not shared between families. I understand and agree that as a registered family of Muse Arts, I am accepting and voluntarily assuming the risk that I or my child may be exposed and become ill as a result of COVID-19 and other diseases.
WAIVER OF LIABILITY: I, on behalf of myself, my caregivers, and my child/children, hereby voluntarily release, forever discharge, and covenant not to sue Muse Arts LLC and its owners, managers, contractors, members, employees, agents, and volunteers, or the outdoor location owner ("Released Parties") for any claims that may arise out of or relate in any way to my, my caregivers', or my child's/children's exposure to any communicable disease, including but not limited to the novel coronavirus (COVID-19) or any other accident that may cause harm. I also assume the inherent risk of being outdoors with my child/children including but not limited to ticks, bees/yellowjackets, insects, poison ivy, or other outdoor hazards. The claims hereby released include, but are not limited to, claims of negligence against any of the Released Parties.
Terms & Conditions for In-Person/Outdoor Classes
Refund Policy: We do not offer tuition refunds after classes begin, although credit toward future classes may be issued in exceptional circumstances. A fee of $30.00 will be deducted if cancellation occurs prior to the first class.
Class Cancellations: Muse Arts reserves the right to cancel classes due to low enrollment. In such a case, we will make every effort to place you in another class. If we cannot place you in another class, a refund for the unused classes will be given.
Make-Up Policy: Families may schedule a make-up in another Muse Arts class, where space permits. Make-up classes must be scheduled within the current session, and cannot be carried over to future sessions. To schedule a make-up class, visit Schedule a Make-Up Class under the Enrolled Families menu on the Muse Arts website.
Dates and Events: It is the responsibility of the parent/guardian to be aware of all session dates and holidays. Muse Arts will include all class dates in your Welcome Letter/Enrollment Confirmation.
Inclement Weather Policy: In the event of inclement weather, the class will be held on Zoom. This can occur if there is precipitation in the forecast, if the ground is too wet, or if the temperature is below 50˚. Muse Arts will make a determination at least 2 hours before the class start time, and notify enrolled families via text and email. Please know that while Muse Arts will do everything in their power to make a decision based on the most up-to-date weather forecast, the weather may change in unpredictable ways. If an unpredictable change in the weather does occur, we will proceed with the outdoor class as scheduled.
Covid Safety Policy: In order to do our best to keep everyone safe and healthy, the following MUST be adhered to:
Stay home if anyone in your household is exhibiting any of the following Covid-19 symptoms: fever or chills, cough, shortness of breath or difficulty breathing, fatigue, muscle or body aches, headache, new loss of taste or smell, sore throat, congestion or runny nose, nausea or vomiting, or diarrhea.
Stay home if you or anyone you've been in close contact with has been exposed to Covid-19.
In the event that New York State Covid-19 protocols change and no longer allow class to meet in person, our class will be held on Zoom.
Injuries: Parents, legal guardians of minor students, and adults students waive the right to any legal action for any injury sustained at Muse Arts venues resulting from normal class activity or any other activity conducted by families before, during, or after class time.
Privacy: Muse Arts does not sell or give personal information to third parties without express consent. Muse Arts will use your personal contact information for:
Delivering session/class information and reminders via phone, email, and mail.
Promotions that Muse Arts may run from time to time.
Promotions that Muse Arts may receive from community and business partners from time to time.
By enrolling in a Music Together class at Muse Arts, a licensed Music Together center, you agree that any information you provide will be shared with Music Together Worldwide. By enrolling in a Canta y Baila Conmigo class at Muse Arts, a licensed Canta y Baila Conmigo center, you agree that any information you provide will be shared with Canta y Baila Conmigo LLC.
Changes to Terms & Conditions: The Terms & Conditions are subject to change at any time, and the most recent version of them will be posted to our website. All registered parties agree to the terms herein, as well as changes to these policies when posted to the website.
